Acknowledgement of Our Privacy Policy

Finetune knows that you care how individually identifiable information about you ("Personal Data") is collected, used and shared when you use our services. This notice describes our privacy policy. By using web sites operated by Finetune and/or any Finetune powered audio services (collectively, the "Finetune Services"), you are accepting the practices described in this Privacy Policy and agree that we may collect, use and transfer Personal Data about you as set forth herein. This Privacy Policy applies only to information that is collected through the Finetune Services. If you do not agree with these terms, you may choose not to use the Finetune Services, and please do not provide any personal information to Finetune through the Internet. This Privacy Policy forms part of our Terms of Use and such shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts. You agree to submit any dispute arising out of your use of this web site to the exclusive jurisdiction of the Commonwealth of Massachusetts.

Changes to the Finetune Privacy Policy

The Finetune Services and our business may change from time to time. As a result, at times it may be necessary for us to make changes to this Privacy Policy. Finetune reserves the right to update or modify this Privacy Policy at any time and from time to time without prior notice. Please review this Privacy Policy periodically, and especially before you provide any Personal Data. This Privacy Policy was last updated on June 30th, 2006. Your continued use of the Finetune Services after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.

Information That You Give Us

We collect Personal Data from you when you voluntarily choose to register for or use certain Finetune Services. Specifically, if you decide to become a registered listener we collect the following items:

  1. E-mail address
  2. First and Last Name
  3. Certification that you are at least 13 years of age

In addition we may ask you for Personal Data if you enter contest or promotion sponsored by Finetune. When you contact Finetune we may keep a record of that correspondence and may occasionally ask you to complete surveys. Wherever Finetune collects Personal Data we will provide a link to this Privacy Policy.

Personally Non-Identifiable Information

Passively Collected Information: When you interact with Finetune through the Finetune Services, we receive and store certain data that is not personally-identifiable (the "User Data"). Such User Data, which is collected passively using various technologies, is not used to specifically identify you. Finetune may store such User Data itself or it may be stored in databases owned and maintained by Finetune's affiliates, agents or service providers. We will use such User Data together with data provided by other parties and pool it with other information in order to analyze the use of the Finetune Services.

Aggregated Personal Data: In an ongoing effort to better understand and serve our users, Finetune often conducts research on its customer demographics, interests and behavior based on aggregated Personal Data ("Aggregated Personal Data"), User Data and other information provided to us. This research may be compiled and analyzed on an aggregate and anonymous basis, and Finetune may share this Aggregate Personal Data with various third parties. This Aggregated Personal Data does not identify you personally. Finetune may also disclose Aggregated Personal Data and User Data in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.

Cookies: In operating the Finetune Services, we may use a technology called "cookies." A cookie is a piece of information that the computer that hosts our Finetune Services gives to your browser when you access a Web site. The first time you use Finetune Services, we send a cookie to your browser, which may then be stored on your system. This cookie is only used on future visits to determine whether you have used the Finetune Service before. This cookie does not contain any personal information and it is only used so that we can create aggregate listening statistics.

Our Use of Personal Data

We use Personal Data in a manner that is consistent with this Privacy Policy. We use the Personal Data that we collect in our efforts to provide you with the Finetune Services and to improve and market Finetune Services. Finetune may store such Personal Data itself or it may be stored in databases owned and maintained by Finetune&apso;s affiliates, agents or service providers.

If you provide Personal Data for a certain reason, that Personal Data will be available to us for use in connection with the reason for which it was provided or for a consistent purpose. Finetune and its affiliates may also use your Personal Data, User Data and other information collected through the Finetune Services to help us improve the content and functionality of the Finetune Services, to better understand our customers and markets, to improve our products and services and to effect and facilitate sales.

Next Radio and its affiliates may sometimes use e-mail addresses and other Personal Data to contact users who provide their e-mail addresses for specific purposes. Each communication will contain instructions on how to discontinue receipt of such communications.

Sharing of Personal Data

Finetune considers your information to be a vital part of our relationship with you. Finetune may share your Personal Data with our subsidiaries and affiliates that have also agreed to be bound by this Privacy Policy. In addition, Finetune, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples include mailing information, maintaining databases and processing payments. When we retain another non-affiliated company to perform a function of this nature, we seek to provide them with only the information that they need to perform their specific function, and we require them to protect your Personal Data in accordance with this Privacy Policy. In addition, if you input Personal Data on a co-branded registration page, relating, for example, to a contest co-sponsored by both Finetune and a partner company, then your Personal Data will be available both the Finetune and to such partner company. While Finetune will only use such Personal Data in accordance with this Privacy Policy, such partner company's use of your Personal Data will be subject to the privacy policy of that company and Finetune cannot be responsible for their use of your information. We encourage you to review the privacy policy of such partner company before providing information on any such co-sponsored page or promotion.

There are also a limited number of circumstances in which we may share your Personal Data and other information in our possession with certain additional third parties without further notice to you, as set forth below:

Legal Requirements: Finetune may disclose your Personal Data, User Data and other information if required to do so by law or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect and defend the rights or property of Finetune or its affiliates, (c) act in urgent circumstances to protect the personal safety of our customers or the public, or (d) protect against legal liability.

Business Transfers, Combinations and Related Activities: As we develop our business, we might sell, buy, restructure or reorganize businesses or assets. In the event of any sale, merger, reorganization, restructuring, dissolution or similar event involving our business or assets, Personal Data may be part of the transferred assets.

A Note About Children

The Finetune Services are not intended for and are not directed at children under the age of 13. Finetune does not collect Personal Data from users under the age of 13. If any listener indicates that they are 13 or younger, data collected in the registration form is purged and never transmitted to Finetune servers.

Security

We take reasonable steps to protect any Personal Data you provide to us and to protect such information for loss, misuse and unauthorized access, disclosure, alteration or destruction. We take reasonable efforts to limit the number of people who have physical access to its database servers and we utilize electronic security systems and password protections, which help to guard against unauthorized access. Be cautioned, however, no Internet or e-mail transmission is ever fully secure or error free. Therefore, you should take special care in deciding what information you send to us via the Internet.

The Finetune Services may contain references or links to other web sites not operated or controlled by Finetune (the "Third Party Sites") none of which sites are governed by the policies and procedures we describe here.
